The Court of Appeal has today handed down its judgment in the matter of Potanina v Potanin, for the second time finding in favour of Mrs Potanina and the merits of her claim. Mrs Potanina was represented by Partners Frances Hughes and Bryan Jones, and Senior Associate Sarah Walker.

The Court of Appeal considered that Mrs Potanina had demonstrated that “she had substantial ground for making the application” and that she should be granted leave to proceed with it. The court described her as “fully entitled” to bring her claim “without any discount or special factor limiting her claim”.

Frances Hughes commented that “the decision of the Court of Appeal is a second vindication of our client in making her application in 2019. Our client is grateful for the consideration given by the court to her case and is delighted that the Court of Appeal has recognised, for the second time, the merits of her application. She very much hopes that her case can now be resolved and can be concluded without further delay”.

The case will now be remitted to the High Court where a decision will be made on what award Mrs Potanina should receive, with the Court of Appeal having found that “the wife was in a strong position to argue in all of these circumstances, that it would be ‘appropriate’ for the court in this country to make an award”.
