Hughes Fowler Carruthers win notable appeal case
In a Court of Appeal case, Lady Justice King and Lord Justice Hamblen has found in favour of Christina Estrada and dismissed Dr Al-Juffali’s appeal, and permitted her financial claims against him in respect of their marriage to proceed.
The Court of Appeal has clearly stated that Dr Al-Juffali is permanently resident in the UK, and so cannot claim diplomatic immunity in respect of Ms Estrada’s claims, having chosen to maintain his family base in the UK for 35 years.
Mr Justice Hayden’s finding that Dr Al-Juffali secured his appointment “with the sole intention of defeating [Ms Estrada’s] claims,” stands. The judgement can be found here.
Frances Hughes said: “The Court of Appeal’s judgement today is another vindication of Ms Estrada’s stance. My client thanks the Court of Appeal for disposing of Dr Al-Juffali’s appeal so swiftly, and she hopes now that settlement can be achieved which will provide security for herself and their daughter.”
These financial claims have now been listed for a final hearing in June 2016.
