Insights into the matrimonialisation of assets

Following the Court of Appeal’s recent decision in Standish v Standish, the concept of matrimonialised assets has been solidified, preserving the starting point that the sharing principle is applied to matrimonial assets and not to non-matrimonial assets.

Writing in ThoughtLeaders4’s HNW Divorce Magazine, partner Lauren Deane and associate Charlotte Jeanroy discussed in detail the impacts of the Standish decision, noting that it reaffirms the origin of an asset carries determinative weight rather than the current legal and beneficial ownership.

They further explained that this decision is an affirmation of the preceding case law, and has allowed for continued arguments on the facts of the case, while still offering overarching principles to guide the determination of a fair outcome.
