Senior Associate Liam Bennett is today speaking at the ThoughtLeaders4 HNW Divorce Next Gen Summit in London.

Liam is speaking on the panel titled ‘Understanding Part III and International Divorces’, exploring the workings of Part III of the Matrimonial and Family Proceedings Act 1984 and how and when parties can bring a claim for financial relief following a foreign divorce in England and Wales.

The panel will examine the criteria for leave to bring a claim, as well as the factors the court considers when determining the substantive application. Discussion will also focus on the strategic use of Part III in international cases involving forum shopping.

Speakers will consider how the English courts approach foreign marital agreements, including the weight that may be given to marital contracts entered into abroad, and further explore recent case law developments and their practical implications for practitioners advising internationally mobile high-net-worth families.

Hughes Fowler Carruthers continues to act for the wife in one of the most notable Part III cases litigated in the English courts, Potanina v Potanin, which has helped shape the modern approach to Part III claims following a foreign divorce and will play a role in this panel discussion.
